Welcome to Rescue for Paws. The term “Rescue for Paws,” “we,” “us,” and “our” refer to the brand and online store operating at this website. Rescue for Paws is powered by Shopify, which enables us to provide our services to you. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). Please read these Terms carefully before using the Services. By visiting, browsing, or purchasing through our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
SECTION 1 – ACCESS AND ELIGIBILITY
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our Services for any illegal or unauthorized purpose. You are responsible for all activity occurring under your account and for keeping your account credentials secure. You may not transfer or assign your account to any other person.
SECTION 2 – OUR PRODUCTS
We have made every effort to display our products as accurately as possible. Colors and appearance may vary depending on your device and screen settings. We do not warrant that product quality or appearance will meet your expectations or exactly match what is depicted on our website.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities available to any person, region, or jurisdiction at our sole discretion.
Rescue for Paws is a brand committed to animal welfare. As part of our brand identity and from our own business revenues, we support organizations involved in the care of dogs in need. This support is funded by Rescue for Paws from its own operating income. Purchases made by customers constitute payment for products and services only. No portion of any customer payment constitutes a donation, charitable contribution, or gift within the meaning of applicable tax law, and no purchase entitles the customer to any tax deduction.
Communications about our support for animal welfare describe Rescue for Paws’s own activities and commitments, and do not constitute a public solicitation of funds or a promise of specific performance tied to any individual customer order.
SECTION 3 – PAWS CLUB MEMBERSHIP
Rescue for Paws offers an optional monthly membership program called “Paws Club” (the “Membership”). By subscribing to the Membership, you agree to the following terms:
Membership Fee: The Membership is billed at approximately $25.00 USD per month. The exact price will be displayed at the time of subscription.
Benefits: Active Paws Club members receive a 15% discount code delivered by email, applicable to future purchases on our website. Members also receive access to exclusive member content, including our members’ gallery. Benefits are subject to change with reasonable notice.
Billing: Membership fees are charged on a recurring monthly basis. Your payment method will be charged automatically at the start of each billing cycle. Membership fees are non-refundable except as required by applicable law.
Cancellation: You may cancel your Membership at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days in a billing cycle.
Rescue for Paws reserves the right to modify, suspend, or discontinue the Paws Club program at any time with reasonable notice to existing members.
SECTION 4 – ORDERS
When you place an order, you are making an offer to purchase. Rescue for Paws reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Rescue for Paws confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. Rescue for Paws may be unable to accommodate cancellation requests after an order is accepted. In the event we cancel or modify an order, we will notify you using the contact information provided at checkout.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent that your purchases are for personal or household use and not for commercial resale or export.
SECTION 5 – PRICES AND BILLING
Prices are subject to change without notice. The price charged will be the price in effect at the time of your order, as set out in your order confirmation email. Unless otherwise stated, prices do not include taxes, shipping, handling, or import charges.
You agree to provide accurate and complete payment information for all purchases. You represent that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method; and (iii) charges will be honored by your payment provider.
SECTION 6 – SHIPPING AND DELIVERY
All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once your order is transferred to the carrier, risk of loss passes to you. We will assist you with carrier claims for packages lost or damaged in transit.
SECTION 7 – INTELLECTUAL PROPERTY
All content on our Services, including text, images, graphics, logos, and designs, is the property of Rescue for Paws or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any content from our Services without our prior written consent.
The Rescue for Paws name, logo, and related marks are trademarks of Rescue for Paws. Shopify’s name, logo, and marks are trademarks of Shopify Inc. All other trademarks are the property of their respective owners.
SECTION 8 – THIRD-PARTY LINKS AND TOOLS
Our Services may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party sites. Accessing third-party content is at your own risk. We may also provide optional third-party tools on an “as is” basis, without warranties of any kind.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Rescue for Paws uses Shopify to power its online store. All transactions are made directly with Rescue for Paws. Shopify is not responsible for any aspect of transactions between you and Rescue for Paws, including any loss, damage, or injury arising from purchased products. You expressly release Shopify and its affiliates from any claims arising from your purchases.
SECTION 10 – PRIVACY
All personal information collected through our Services is subject to our Privacy Policy. Our Services are hosted by Shopify, which also processes certain personal information as described in Shopify’s Privacy Policy. By using our Services, you acknowledge that you have read and understood our Privacy Policy.
SECTION 11 – USER FEEDBACK
If you submit any ideas, reviews, suggestions, or other feedback (“Feedback”), you grant Rescue for Paws a perpetual, royalty-free, worldwide license to use, reproduce, modify, and publish that Feedback for any purpose. You represent that you own all rights in your Feedback and that it complies with these Terms.
SECTION 12 – PROHIBITED USES
You may use our Services only for lawful purposes. You may not: (a) violate any applicable law or regulation; (b) infringe any intellectual property rights; (c) transmit false or misleading information; (d) upload malicious code or interfere with the operation of our Services; (e) collect personal information of others without consent; (f) use the Services for commercial resale or exploitation; or (g) engage in any conduct that restricts or harms other users or Rescue for Paws.
We reserve the right to suspend or terminate your account at any time for violation of these Terms.
SECTION 13 – DISCLAIMER OF WARRANTIES
THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
SECTION 14 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, RESCUE FOR PAWS, ITS PARTNERS, AFFILIATES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR SIMILAR DAMAGES, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.
SECTION 15 – INDEMNIFICATION
You agree to indemnify and hold harmless Rescue for Paws, Shopify, and their affiliates, officers, employees, and agents from any claims, losses, or liabilities arising from (1) your breach of these Terms, (2) your violation of any law or third-party rights, or (3) your use of the Services.
SECTION 16 – DISPUTE RESOLUTION
Informal Resolution. Before filing any claim, you agree to contact us at info@rescueforpaws.shop with a written description of your dispute and give us sixty (60) days to resolve it informally.
Binding Arbitration. If we cannot resolve a dispute informally, any dispute arising from these Terms or our Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except: (a) either party may bring an individual claim in small claims court; or (b) either party may seek injunctive relief for intellectual property infringement. The Federal Arbitration Act governs this section.
Class Action Waiver. YOU AND RESCUE FOR PAWS AGREE THAT EACH PARTY MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
Opt-Out. You may opt out of this arbitration agreement by emailing info@rescueforpaws.shop with the subject “Arbitration Opt-Out” within thirty (30) days of your first acceptance of these Terms, including your name, address, and order number.
Time Limit. Any claim arising from the Services must be filed within one (1) year after the claim arose, or it is permanently barred.
SECTION 17 – GOVERNING LAW
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law provisions, except that the Federal Arbitration Act governs the arbitration provisions. Any disputes proceeding in court shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
SECTION 18 – CHANGES TO TERMS
We reserve the right to update these Terms at any time. Material changes will be communicated in accordance with applicable law. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
SECTION 19 – SEVERABILITY AND WAIVER
If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full force. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
